GENERAL CONDITIONS OF SALE LAWSON COSMETICS
Article 1 - Scope of the General Terms and Conditions of Sale
This website is published by SAS LAWSON COSMETICS, with a capital of €1,000.00, whose registered office is located at 34 avenue des Champs Elysées in Paris (75008), registered with the Paris Trade and Companies Registry under number 883 563 009.
The present general conditions of sale apply to all orders placed on or with the Internet site www.lawsonparis.com.
They concern only natural persons with the status of consumer (hereinafter called the Customer), major, and having the legal capacity to contract. The web site of www.lawsonparis.com proposes to the Customer the sale of all products relating to the perfumery, the cosmetic, and the products of beauty. Prior to his order, the Customer declares that the acquisition of these products is intended for a use not related to his professional activity. Any order placed on the site www.lawsonparis.com . website implies that the Customer has read and understood these general terms and conditions of sale and agrees to the entirety of their content. LAWSON COSMETICS reserves the right to adapt or modify these terms and conditions of sale at any time. In this case, only the general terms and conditions of sale in effect at the time the order was placed shall apply. The date of the last update is mentioned at the top of these terms and conditions. LAWSON COSMETICS advises the Customer to save and/or print out these terms and conditions of sale for safekeeping and to be able to refer to them at any time during the performance of the contract if necessary. For the purposes of these Terms and Conditions, the Customer shall be understood to be the party with whom the purchase-sale relationship is established and who will be invoiced for the order.
Article 2 - The Prize
2.1. All the prices of the products proposed with the sale on the www.lawsonparis.com site. are expressed in euros all inclusive of tax except share in the expenses of forwarding. These expenses of forwarding are hereafter consultable.
2.2. LAWSON COSMETICS reserves the right to modify its prices at any time (in particular in the event of a VAT increase) but undertakes to apply the prices in effect at the time the order is registered, subject to the availability of the products on that date.
2.3. The products remain the property of LAWSON COSMETICS until full payment is received. However, upon collection or receipt of the order by the Customer or its representative, the risks of the goods collected or delivered shall pass to the Customer.
2.4. The shipping costs will be communicated in addition to the price of the product.
Article 3 - The Order - Order Validation
3.1. Orders are placed on the website www.lawsonparis.com .
3.2. The contractual information is presented in French.
3.3. The products are offered for sale in metropolitan France, in Corsica and in the European Union.
3.4. To place an order, the Customer follows the different steps of the order scrolling on the site, namely: - the selection of the chosen item(s) by the heading "my basket",- the Customer identification by the heading "my account",- the terms and conditions of delivery by the heading "delivery",- the terms and conditions of payment by the heading "payment",- the finalization of the order by the heading "confirmation
3.5. The attention of the Customer is particularly drawn to the mode of acceptance of the order placed on the website www.lawsonparis.com. The "double click" and the check box on the acknowledgement and acceptance of the general conditions of sale, validating the order is worth "electronic signature" and is equivalent to a handwritten signature. They constitute an irrevocable and unconditional acceptance of the order by the Customer. Unless proven otherwise, the data recorded by LAWSON COSMETICS on the Internet constitutes proof of all transactions between the company and its customers.
3.6. The contractual information relating to the order (including the order number) will be confirmed by e-mail in due course and at the latest at the time of delivery/delivery. LAWSON COSMETICS strongly advises the Customer to print and/or file this order confirmation on a reliable and durable medium as proof. A digital invoice is made available to the Customer in the "my account" area. 3.7. The information provided by the Customer when placing the order (in particular name and delivery address) is binding on the Customer. Thus, LAWSON COSMETICS shall not be held liable in the event that an error in placing the order prevents or delays delivery.
3.8. LAWSON COSMETICS reserves the right to refuse any order from a customer with whom there is or has been a dispute over payment of a previous order placed with LAWSON COSMETICS.
3.9. The Customer declares that he has full legal capacity to commit himself under these general conditions of sale.
Article 4 - Availability
4.1. The offers of products and prices are valid as long as they are visible on the site, within the limits of available stocks.
4.2. In case of unavailability of product after placing the order, the Customer will be informed of the time period within which the product will be made available. The Customer who does not wish to wait for this availability or in case of definitive unavailability of the product, will be reimbursed the price of the product if his bank account has been debited, and this within 7 days following the effective date of payment.
Article 5 - Payment
Orders are payable in cash on the day of the order. The payment is made by credit card with one of the following acronyms: CB, Visa, Mastercard. The order shall only be considered accepted by LAWSON COSMETICS once the relevant bank payment centers have given their approval and LAWSON COSMETICS has validated the order in accordance with its risk acceptance criteria. In the event of acceptance of the file by the payment center and by LAWSON COSMETICS, the customer shall be informed by sending an order confirmation by e-mail. If the file is rejected, the order will automatically be refused and the customer will also be informed by e-mail.
Article 6 - The Invoice
An invoice is issued for each delivery and sent by LAWSON COSMETICS by mail or e-mail to the Customer at the billing address provided by the Customer when placing the order. Any complaint regarding invoices must be brought to the attention of the Company by e-mail within 7 days of receipt at www.lawsonparis.com . . Otherwise, they are considered as accepted without any reserve. The possible incomplete delivery of an order cannot justify the refusal of payment of the delivered Products. Any dispute between the Customer and LAWSON COSMETICS shall in no way be a cause for suspension of payment of the undisputed part of the invoice.
Article 7 - Delivery
The delivery time depends on the actual availability of the products at the time of the order.
The products are delivered to the delivery address indicated by the customer on his order form. If the customer is absent, a notice of passage of the carrier in his mailbox invites him to contact him to rearrange later the delivery of the package, or to withdraw it at the nearest post office.
For deliveries within the European Union, delivery times may be extended.
Three modes of delivery are proposed to the Customer:
7.1. Standard Home Delivery via Colissimo :
Delivery of ordered and paid products to the address chosen by the Customer: This is done via the services of LA POSTE. It will be delivered within 2 to 3 working days after the departure of the warehouse for any order placed before 2 p.m. maximum from Monday to Tuesday and before 10 a.m. on Saturday, subject to availability of products.
7.1.1. Colissimo Domicile - without signature
Once the parcel is prepared by us, it will be delivered to you within 72 hours after its departure from the warehouse, directly into your mailbox. If this one is not big enough and you are absent, a notice of passage will be deposited to you allowing you to choose on Internet a new date of delivery in the 6 wrought days or to recover your parcel as of the following day 15h in the post office of your choice. If you do not choose a delivery date, you will be able to pick up your parcel at your local post office within 15 days.
No dispute relating to the delivery itself is possible if the package appears to have been delivered, the computer system (flashing) of the Post Office being evidence.
7.1.2. Colissimo Domicile - with signature
Once the parcel is prepared by us, it will be delivered to you within 72 hours after its departure from the warehouse and given against signature. If you are absent, a notice of passage will be deposited allowing you to choose on Internet a new date of delivery within 6 working days or to recover your parcel as of the following day 15h in the post office of your choice.
If you don't express a choice, you will be able to recover your parcel in your post office of attachment, within 15 days.
7.2. Delivery in Point Retrait via Colissimo :
Delivery of the ordered and paid products in a collection point selected by the Customer: This is done via the services of LA POSTE. It will intervene within an indicative time of 48h days days after the departure of the warehouse for any order placed before 14 hours maximum from Monday to Tuesday and before 10 am on Saturday subject to availability of products.
You will be informed of the availability of your package by SMS and e-mail (please note that these can be placed in your spam folder by your email).
No dispute relating to the delivery itself is possible if the package appears to have been delivered, the computer system (flashing) of the Post Office being evidence.
7.2.1. At the Post Office: you can choose the establishment in which you wish to be delivered (without preliminary passage of your factor at home) among the 10 000 post offices available everywhere in Metropolitan France.
You can then pick it up within 10 working days. After this period, your package will be returned to us.
7.2.2. In a Pickup relay: you can choose one of the 7,500 local retailers in the Pickup network, close to your home, your workplace or your vacation destination, to which you would like to have your goods delivered
You can then pick it up within 10 working days. After this period, your package will be returned to us.
7.2.3. In a Pickup Station: you can choose one of the 500 automatic pickup lockers to have your package delivered. Located on your route (train station, subway, parking lot, shopping malls...) they are accessible 7 days a week and 24 hours a day (except for lockers subject to the schedules of shopping malls and transportation areas)
You will be informed of the availability of your package by SMS and e-mail. The latter will specify your withdrawal codes allowing you to withdraw your package during 3 working days. After this period, your package will be returned to us.
7.2.4. Delay & Force Majeure
Any delays shall not entitle the Buyer to claim damages from LAWSON COSMETICS. In any event, timely delivery shall only occur if the Buyer is up to date with its obligations to the Seller.
The following shall be considered as force majeure discharging LAWSON COSMETICS from its obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being supplied or any other cause beyond the control of the seller.
7.2.5. Inability to Deliver
In case of incomplete address, wrong address, refusal of packages by the recipient or lack of information leading to an impossibility to deliver the product to the recipient in time, the site and time, the site www.lawsonparis.com can not be held responsible for non-compliance with the time slot and / or the delivery date.
If this lack of information leads to a second presentation at the delivery address, the site will be entitled to ask the customer for the costs corresponding to this second delivery.
Article 8 - Compliance
8.1. The Customer must check the conformity of the goods delivered or collected before signing any delivery document. In the event of a discrepancy, the Customer shall indicate his reservations directly on the delivery document, followed by his signature. In the event of a serious anomaly (torn or open packaging, missing or damaged products, etc.), the Customer shall refuse the package and specify the reasons for his refusal on the delivery document. This verification is considered to have been carried out as soon as the Customer, or any person authorized to receive the package on his behalf, has signed the delivery document. The Customer must also confirm the reservations to LAWSON COSMETICS Customer Service (at the following address LAWSON COSMETICS Customer Service, 34 avenue des Champs Elysées, Paris 75008) within 3 working days of receiving the item(s). Any claim made outside of this period will not be accepted.
8.2. LAWSON COSMETICS undertakes to reimburse or exchange any products that do not comply with the Customer's order. To do so, the Customer shall send an e-mail, telephone or letter to LAWSON COSMETICS Customer Service, 34 avenue des Champs Elysées in Paris (75008)within 30 days of delivery, any claim relating to the non-conformity of a product with its order and shall specify on this occasion its choice between a refund or an exchange. Any claim made outside of this period shall not be accepted. LAWSON COSMETICS will reimburse the customer for the cost of returning the product.
8.3 In all cases referred to in this article 8, the return of products can only be accepted for complete, unopened products in their original condition. In these cases, the return costs will be charged to the customer.
Article 9 - Withdrawal
9.1. Cn accordance with the provisions of the Consumer Code, the buyer has a period of 14 working days to a period of 14 working days from the date of delivery of his order, to return any item that does not suit him and ask for an exchange or refund without penalty, except for the return costs which remain the responsibility of the buyer.
The returns are to be made in their original condition and complete (packaging, protective plastic film, blister, accessories, instructions ...) allowing their remarketing in new condition.
Indeed, in accordance with the provisions of Article L.221-28 of the Consumer Code, the opening of beauty products (cosmetics and makeup) making these products unfit for further marketing, the "Customer" has no right of withdrawal on any cosmetics that have been opened, damaged, or whose original packaging unsealed. The product will not be reimbursed, nor taken back, nor exchanged, and this for reasons of hygiene and health protection.
If you wish to retract, the return costs remain at your charge. The return of the parcel must be made or deposited at the following address from Tuesday to Saturday from 9h30 to 12h and from 14h to 17h30 :

Article 10 Security
The Customer's credit card information benefits from the SSL encryption process. This information is sent directly to LAWSON COSMETICS' bank, and is therefore not transmitted to or stored on LAWSON COSMETICS' servers.
Article 11 - Intellectual Property
All texts, comments, works, illustrations, images and photographs, trademarks and databases reproduced and integrated on the site www.lawsonparis.com . are protected, for the whole world, in particular under the title of the intellectual property and the royalty. As such and in accordance with the provisions of the code of intellectual property, only the use for a private use is authorized. Any total or partial reproduction of the site www.lawsonparis.com is strictly forbidden. In particular, any reproduction or use for purposes other than private of the brands it contains (concerning which the LAWSON COSMETICS benefits, for the only needs of its activity, of an authorization of diffusion, of reproduction on its site, and of marketing of the products which are coated with it), is strictly prohibited.

Article 13 - Applicable Law and Disputes
13.1. The present general conditions of sale and the online sales contract are subject to French law.
In the event of a dispute or claim, the Customer is advised to contact the Customer Service Department in order to seek and find an amicable solution (For any contact, please refer to article 11 above).

It may be used for commercial prospecting and promotional communication related exclusively to the activities of LAWSON COSMETICS or to any administrative or judicial authority that may request it. PRE-ORDER
By placing a pre-order, the Customer acknowledges that if the pre-order goal mentioned on each pre-order product sheet is not reached by the end of the pre-order deadline, the Customer will be refunded the full amount of the purchase, and the production of the pre-ordered item will not be launched.
